2 men who attacked mamak worker in Cyberjaya get arrested, pleads not guilty to their respective charges

Last week, two men in Cyberjaya caught the attention of Malaysians across the country after they were filmed attacking a mamak staff, leading many to call local authorities to look into the matter. Following the incident, both suspects, identified as Elanggovan Muniyandi and Vengateswaran Malaisamy, have since been detained over the assault.

As the brawl was captured on video, authorities were able to detain the 2 assailants who are both 51 years old. Through initial investigations, authorities have found out that both the assailants are friends and the fight had allegedly broke out because the staff has told them to not pick the food they want with their bare hands.

Local newspaper NST has reported that the duo have been slapped with one count of committing mischief under Section 427 of the Penal Code by throwing plates belonging to the restaurant, for uttering obscenities under Section 509 at the restaurant’s foreign workers, as well as another count of causing voluntary hurt to the employee under Section 323 of the Penal Code.

Separately, Elanggovan has been charged with an additional offence under Section 324 of the Penal Code for voluntarily causing hurt with a pair of tongs. The duo has also been instructed by court to not disturb the victims for a month.

If convicted, Elanggovan would face an imprisonment term for up to 10 years and/or a fine, while Vengateswaran would face an imprisonment term for up to 5 years and/or a fine.

According to Deputy public prosecutor Nur Sabrina Zubairi, bail was set at RM24,00 and RM17,000 respectively but the accused’s lawyer, Lingeswaran Andiappan pleaded for a lighter bail in light of their financial circumstances.

He explained that Elanggovan, who is married with 3 kids only earns RM2,000 a month as a van driver while Vengateswaran earns about RM800-900 as a taxi driver, while caring for his wife and mother. The bail amount was subsequently reduced to RM8,600 and RM11,600.

The accused’s lawyer has also submitted that the bail set for the duo to only be punitive if they fail to show up at court. Following that, the duo has since pleaded not guilty to the charges. Their trial will commence on May 10th.
